Gawker Gives in and Takes Down Eric Dane’s Sex Tape

The Internet just got a little less steamy today. Mediaite reports that Gawker — which was hosting an edited version of a naughty, naked video of Eric Dane, his wife Rebecca Gayheart, and former beauty queen Kari Ann Peniche — has agreed to remove the sex tape from its site and pay the married couple an undisclosed sum.

Dane and Gayheart sued Gawker in September for copyright infringement. Evidently, auteur Eric Dane felt he should be compensated for his camera work.

Gawker hasn't yet announced the vid’s disappearance on its own site, but the Hollywood Reporter has a statement from Gawker COO Gaby Darbyshire saying that although the video was protected under fair use, "because the posts already had been available to our readers for nearly a year, and because we already had won an important decision from the court striking large parts of the plaintiffs' damages claims, we agreed to remove the posts as part of a global settlement to avoid the burden of further litigation." We think everyone should stop calling them sex tapes, since they obviously can't be as easily erased as a VHS. To all you famous folks out there: Think before you film!
