Will Kris Humphries Be Named the Father on the Birth Certificate of Kim Kardashian’s Baby?
Kim Kardashian’s drawn out divorce from Kris Humphries seems to be raising all sorts of questions concerning the reality star’s recently announced pregnancy. Citing California laws regarding marriage, TMZ reported that the NBA player would be presumed to be the father of Kim’s baby, even though it’s been more than a year since the couple separated. Furthermore, Kim and boyfriend Kanye West would supposedly have to present “clear and convincing evidence” that they conceived the child together.
As much as we’d love to know what that “evidence” looks like, the Huffington Post is calling foul on this assessment altogether.
A family law expert explained that, according to California state law, a couple must be cohabitating in order for a judge to assume that a woman’s husband is the father of the baby.
“Since Kim and Kris are separated the presumption of Kris as the father would not apply,” said lawyer David T. Pisarra. “I imagine that when baby Kimye is born, Kim will name Kanye as the father and he will sign a Declaration of Paternity, just like thousands of other unmarried couples do.”
