Kim Kardashian’s ex-husband is formally asking a judge for a continuance, or a delay, in his approaching sexual battery lawsuit trial after his accuser, Kayla Goldberg, admitted she didn’t actually have proof that Kris gave her herpes.
Kayla originally claimed that she and Kris met in the summer of 2010, before the Boston Celtics player ever met Kim. After a booze-fueled one-night stand with the NBA star in Los Angeles, Kayla said she woke up to a not-so-pleasant surprise a few weeks later. The woman proceeded to sue Kris for sexual battery, claiming the athlete knew he had herpes before the two hooked up and never said a word.
Hoping to put an end to the lawsuit as quickly as possible, Kris immediately denied Kayla’s claims and took a blood test to prove he was STD free.
According to court documents filed by Kris’s lawyers and obtained by RadarOnline.com, “Kayla Goldberg admitted (among other things) that she has no evidence (1) Kris Humphries even has the herpes virus; (2) that Defendant knew or had any reason to believe he was infected with herpes at the time of sexual contact; (3) that Defendant was the cause of her herpes infection (as opposed to any of her past sexual partners.”
Kris’s team has reportedly asked a judge to grant a summary judgment motion in their favor — an action that would avoid a court trial and that might be possible because of Kayla’s lack of evidence for the athlete’s “crime.”
