Today, in our “Poor Amanda Bynes” journal entry, we have to talk a little bit about our favorite 5150 patient. We’ve been worried about her for a while now, and were relieved when she was committed to a psychiatric institute to get the help she needs — no matter how many hundreds of thousands it costs her. But though she is moving forward in her life, today she had to take a peek back at something less pleasant than the future: Her April 2012 DUI.

Amanda was due in court today for her West Hollywood DUI arrest from last spring, but her lawyer is saying that it’s not such a great idea for her to be in trial. TMZ reports that Amanda’s lawyer, Rich Hutton, told the judge in her case that she did not have the mental capacity to understand the nature of the legal proceedings.

Because of this argument, and probably the fact that Amanda has been in a psych facility, the judge transferred the whole shebang to the mental health court. The judge over yonder will declare whether Amanda’s mental state is such that they can proceed with the trial, or whether her lawyer’s theory is sound.

Currently, Amanda is staying at the UCLA Medical Center, where she has been since August 15. Previously, she was being held at a Ventura County center until UCLA could accommodate her. The holds stem from a July 22 incident in which she started a fire in a woman’s driveway. Amanda’s mom gained a conservatorship over her daughter on August 9, and has been taking care of her since then.

We wish Amanda the best in her treatment and hope she gets back to a healthy state soon.
