Radar Online reports that Apollo, 35, currently could be hit with up to 30 years in prison when he is sentenced on July 8. However, his lawyers submitted paperwork on July 3 to ask the Atlanta district court to downgrade his status from Criminal History Category V to Criminal History Category IV.
Apollo's lawyers claim that, while Apollo has committed numerous crimes in his past, he shouldn't be judged too harshly for them because he was much younger when they happened. "Mr. Nida’s lengthy but early small-time criminal history is simply not in the same league as the 'violent offenders, drug kingpins and perpetrators of far more serious offenses' that Criminal History Category V was designed to address," read the documents.
Apollo has had been cited for three probation revocations, driving under the influence, and giving a false name to law enforcement, but all of that was before he turned 24 years old.
