Maksim Chmerkovskiy is already preparing himself to go home — even though he knows he has some of the most loyal fans in Dancing With the Stars history and there’s a good chance he and Melissa Gilbert will be declared “safe” tonight.

Melissa and Maks had the second lowest scores of Season 14’s Latin Week — a 21 out of 30 for their Salsa. That doesn’t mean they are in the bottom two, it depends on the combination of judges’ scores and viewer votes. However, if they *are* in the bottom two during tonight’s Week 5 Results Show, that means they have to launch the new Dance Duel, where the bottom two couples do a little Cha-Cha-Cha for the judges, who will “save” their favorite.

Maks believes that may be their doom — because his history with the judges makes him a “liability” for Melissa.

"I think if we're in bottom two [the] judges are gonna let us go,” Maks told On the Red Carpet after Monday night’s show. “I just think that if we leave it up to the judges they will let us go. I don't know what the deal is, I don't know why."

Melissa nodded in agreement, although she didn’t agree with the start of his next comment.

"I feel almost sorry for Melissa for having me as a partner,” Maks continued. “I feel like I'm a liability. I'm a little upset about today but listen, my job description is not to please the three [judges] over there, it's to do the best I can and get her to joy — and I think she finally did. So as far as I'm concerned, my job here's done and everything from now on is a bonus."

It’s a little too soon to be making farewell speeches, especially since he and Melissa could very well be safe and not have to dance at all. But it’s also possible that — say they do end up in the bottom two — they could be up against the lowest scoring couple, Gavin DeGraw and Karina Smirnoff, and the judges clearly don’t have any preference for their dance abilities. Plus, the judges know which way the wind is blowing. They don’t like to hear that they play “favorites,” so if Melissa and Maks are in the bottom they may go out of their way to show they don’t have favorites by saving The Bad Boy of The Ballroom — even if he does tend to fight with them. It’s all good for ratings, right?

If Melissa and Maks do make it to Motown Week, they will dance a Viennese Waltz and a legendary singer will perform as they dance.
