A judge in Stafford, West Virginia, has decided to ban a mother from spanking her child for a two-year period.
The Fredericksburg Star reports that the ruling was the result of a plea agreement with the mother, Felisha Kimble-Tanks, who practices dentistry in Stafford. Kimble-Tanks was charged with child cruelty after she spanked her 6-year-old daughter with a leather belt. The charge was knocked down from a felony child abuse charge to a misdemeanor: assault and battery on a family member.
The girl’s father, who is estranged from Kimble-Tanks, noticed the bruises on his daughter a few days after the incident and filed a complaint with the Stafford County Sheriff's Office. The girl’s mother said that she was simply trying to discipline her child for misbehaving in school, and did not intend to harm or hurt her.
According to Prosecutor Tara Mooney, “Leaving bruises on a child that young is abuse.” Defense attorney Mark Murphy contends that his client, who has never been in trouble with the law before, never intended to harm her child, citing her own estranged husband’s contention that Kimble-Tanks is a good mother.
