A judge is taking seriously the allegations made by Adrienne Maloof that her husband, Paul Nassif, choked one of their sons last week. TMZ reports the Real Housewives of Beverly Hills star went to court today to file a declaration, and the judge awarded her temporary custody. The couple is in the process of divorcing.

According to TMZ, Paul was driving the couple’s three sons home from school on September 13, when he allegedly choked one of the boys around the Adam's apple to stop him from kicking his brother.

Adrienne and several other witnesses — including her chef, Bernie — filed more declarations about Paul’s behavior, claiming he spanked one of his sons and kicked their dog.

Paul's lawyer, Lisa Meyer, tells TMZ, "This smacks of underhandedness. Adrienne wasn't even present when this allegedly occurred."
