UPDATE: The Miami Herald reports that the city's Historic Preservation Board has voted to move ahead with plans for historic designation of the Hochsteins' mansion, ordering a report to determine the house's historic value. Translation: Hochsteins, the odds aren't so much in your favor.

Miami Beach to Leonard Hochstein: “Hold off on tearing down that mansion of yours — it might be historic.” Leonard Hochstein to Miami Beach: “But my wife, Lisa, and I want a new one!”

OK, we’re paraphrasing, but that’s the gist of the argument between plastic surgeon (and “Boob God”) Leonard Hochstein — who appears with Lisa on REal Housewives of Miami — and the city of Miami Beach. And now Leonard is getting litigious. The Miami Herald reports that Leonard has officially filed suit against the city.

The Hochsteins purchased the Star Island mansion, which was built in 1925, last year and filed an application to tear it down to built a new residence.

As we reported previously, the Hochsteins consider the mansion unsalvageable.

The Miami Design Preservation League quickly submitted their own application to designate the mansion as historic.

Miami Beach has a city code that allows “any organization whose purpose is to promote the preservation of historic sites” But the Hochsteins’ lawsuit declares these rules “unconstitutional” and “illegally enforced.”

Now that the League has submitted that application, the Hochstein’s plans “will be reconsidered in front of a special master,” according to the League’s attorney.

And, as for that lawsuit against the city, city attorney Jose Smith says that it “is without merit and will be vigorously defended and ultimately dismissed.”

Time will tell!
