Things are going from bad to worse for Voice coach and R&B superstar, Usher. The singer’s 5-year-old son, Usher Raymond V, was sent to the ICU of an Atlanta hospital on Monday, August 5 after an accident in his pool.

TMZ reported that the child’s arm got stuck in a drain while he was playing in the pool with his aunt. After the maid and aunt were unable to release the child’s arm, two workers, who were at the home working on the sound system, were able to free and revive him with CPR. An ambulance was called to the scene and little Usher was rushed into intensive care.

The singer was not at his home when the incident occurred, and now his ex-wife, Tameka Foster, is calling for an emergency custody hearing. Ush and Tameka’s custody battle has been nasty over the past few years.

In August 2012, Usher was granted primary custody of the couple's two sons, but in light of recent events, Tameka wants the court to reconsider.

According to ET Online, Tameka filed the claim after Usher “failed to personally exercise physical custody of the minor children, [using] third-party caregivers rather than exercising parenting time.”

She claims that Usher isn’t home “85 percent” of the time and blames his absence for Monday’s accident. The court has now granted Tameka an emergency custody hearing. It’s understandable that Tameka would be on edge after this recent incident. In July 2012 her son Kile was killed in a tragic jet skiing accident.

But we’re also not sure that Usher’s to blame for his son’s poolside incident. And bringing up a custody hearing during such a tragic time seems to be in poor taste.
